Definitions
In these terms and conditions, the term "participant" refers to the person who purchases a ticket to participate in the Sip & Paint workshop. Smaak van Rotterdam is the provider of the workshop, also known as the organizer. The instructors are Brownsarthouse. The purchase of a ticket implies acceptance of the applicability of these terms and conditions.
2. Participation
a. Participation in the workshop is only confirmed when a ticket is purchased and the ticket cost is credited to Smaak van Rotterdam's bank account. The web form specifies the amount that needs to be paid in advance.
b. Each workshop has a limited number of available slots. The number is 50 participants per activity, unless explicitly stated otherwise.
c. Once an activity is fully booked, the registration will be closed, and it will no longer be possible to participate.
d. Smaak van Rotterdam will confirm the ticket purchase and participation in writing via email.
3. Participation Costs
When purchasing a ticket through the online form on the website, the cost per ticket is excluding any fees charged by payment providers.
Smaak van Rotterdam always reserves the right to modify the content or pricing of workshops. Unless otherwise stated, all prices mentioned include 9% VAT.

4. Payment
a. The participant pays directly online upon ticket purchase or at the on-site registration by debit card.
b. Smaak van Rotterdam reserves the right to refuse workshop access to participants who have not fulfilled their payment obligation.

5. Cancellation or Changes
a. For Sip & Paint tickets, there is no cooling-off period, and they cannot be canceled or refunded after purchase. According to European regulations, there is no statutory cooling-off period for event tickets with a specific date.
b. In case of inconvenience, it is possible to transfer the ticket to another person. This should be communicated to Smaak van Rotterdam no later than 2 days before the workshop starts.

6. Cancellation by the Organizer
Smaak van Rotterdam reserves the right to cancel the workshop prior to its start due to insufficient participation, illness, or other forms of force majeure. In such cases, the customer will receive a cancellation notice by email and be eligible for a full refund of the workshop fee.

7. Replacement of the Instructor
Smaak van Rotterdam is entitled to replace the instructor assigned to conduct the workshop with another instructor at any time.

8. Participant's Liability
Tools provided to the participant remain the property of Smaak van Rotterdam at all times. Materials provided to the participant also remain the property of Smaak van Rotterdam at all times. The participant is responsible for handling the provided materials and tools with care. Any damage caused by the participant to Smaak van Rotterdam's tools and belongings will be charged to the participant based on replacement value or repair costs.

9. Liability of Smaak van Rotterdam
a. Smaak van Rotterdam is not liable for any damage to or loss of personal property or personal injury caused by or related to participation in a workshop or damage due to the cancellation of a workshop or event unless Smaak van Rotterdam can be held liable for intent or gross negligence.
b. If Smaak van Rotterdam is liable for any damage despite the provisions of paragraph a, the liability will be limited to a maximum of the paid workshop or package costs. Indirect damage will not be compensated.

10. Applicable Law
Dutch law exclusively applies to all rights, obligations, quotations, orders, and agreements governed by these General Terms and Conditions, as well as to these General Terms and Conditions for Workshops.
If one or more provisions of these General Terms and Conditions or any other agreement with Smaak van Rotterdam should be in conflict with any applicable legal regulation, the respective provision will be deemed void and replaced by a new provision determined by Smaak van Rotterdam that is legally valid and comparable.
All disputes that may arise between the parties regarding an offer, general offer, legal act, agreement, or similar, to which these terms and conditions apply, or resulting from agreements arising therefrom, will be submitted to the competent court in Rotterdam unless the law prescribes otherwise.

11. Privacy
Data provided by the participant will only be used for the execution of the workshop. Provided data will not be shared with third parties.
